Isaac Holmes Music is operated by Isaac Holmes, a sole trader, trading under the name Isaac Holmes Music.

By accessing this Site or purchasing products from it, you agree to these Terms and Conditions, together with our Privacy Policy, Cookie Policy and Returns & Refund Policy.

If you do not agree to these Terms, please do not use the Site.

3. Product Information and Availability

Where a product is described as limited edition, signed, numbered, personalised or otherwise limited, the product description will specify the relevant limitations where applicable.

We reserve the right to correct errors in product descriptions, pricing or availability.

When you place an order, you are making an offer to purchase the relevant product or products.

An order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted.

A contract is formed when we confirm acceptance of your order or dispatch the physical goods, whichever is applicable.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • There is an obvious pricing or description error

  • We suspect fraudulent or unauthorised activity

  • We are unable to fulfil the order

  • There has been an error in the ordering process

If we cancel an order after payment has been taken, you will receive a full refund for the cancelled order.

5. Prices and Payment

All prices displayed on the Site are in British pounds sterling (GBP) unless otherwise stated.

The price applicable to your order will be the price displayed at the time you place the order.

Delivery and shipping charges may be added separately and will be displayed before you complete your purchase.

6. Digital Products and Intellectual Property

All digital content available through the Site, including sheet music, tabs, audio stems, sample packs, backing tracks, downloads and recordings, is owned by or licensed to Isaac Holmes and is protected by UK and international intellectual property laws.

Unless expressly stated otherwise, purchasing a digital product does not transfer ownership of the underlying intellectual property to you.

Digital products are provided under a limited licence for personal, non-commercial use.

You must not:

  • Copy or reproduce digital products for commercial purposes

  • Upload digital products to file-sharing services or other websites

  • Resell, sublicense or redistribute digital files

  • Share purchased files publicly or with other people

  • Use stems, tracks, sheet music or other digital products in commercial projects without appropriate permission

  • Use purchased materials to create or distribute unauthorised derivative products

Where a product is expressly licensed for commercial use, the terms stated on the product page or accompanying licence will apply.

7. Physical Products and Merchandise

Physical products purchased through the Site remain subject to your statutory consumer rights.

Physical products will be packaged appropriately for normal postal delivery.

We will make reasonable efforts to ensure products are dispatched in suitable packaging. However, minor cosmetic imperfections resulting from manufacturing or normal packaging processes do not necessarily constitute a defect.

Nothing in these Terms excludes or limits your statutory rights relating to faulty, misdescribed or otherwise non-conforming goods.

8. Signed, Personalised and Limited-Edition Products

Where a product is described as signed, personalised or limited edition, the relevant product description will specify the nature of the product.

Personalised products may be made specifically according to information provided by the customer.

You are responsible for ensuring that any name, message or other personalisation information supplied when ordering is accurate.

Where a personalised product cannot reasonably be resold because it has been made specifically to your requirements, statutory cancellation rights may not apply where an applicable legal exception applies.

However, this does not affect your statutory rights if the product is faulty, misdescribed or otherwise does not conform to the contract.

9. Delivery and Shipping

Physical products will be dispatched to the delivery address supplied when you place your order.

You are responsible for providing an accurate and complete delivery address.

Available delivery methods, estimated delivery times and shipping costs will be displayed at checkout or on the relevant product page.

We will make reasonable efforts to dispatch orders within the timeframe stated on the Site.

Unless otherwise agreed, physical goods will be delivered within the period required by applicable law.

For international orders, the customer may be responsible for customs duties, import taxes, handling fees or other charges imposed by the destination country.

We are not responsible for delays caused by customs authorities, international postal services, incorrect delivery information or circumstances outside our reasonable control.

Where tracking is available, tracking information may be provided to the customer using the email address supplied during checkout.

You are responsible for providing a valid email address and ensuring that your device and software are capable of accessing the purchased product.

11. Cancellation, Returns and Refunds

If you exercise a valid cancellation right, you may be responsible for returning the goods and, where permitted by law, the direct cost of returning them.

Goods must be returned in accordance with the requirements set out in our Returns & Refund Policy.

12. Digital Content Cancellation Rights

For digital content supplied immediately after purchase, you will be asked to provide the necessary consent and acknowledgement before access begins.

Where required, you will be asked to acknowledge that you lose your statutory right to cancel once supply of the digital content begins.

This does not affect your rights where the digital product is defective or otherwise does not conform to the contract.

Where a refund is approved, it will normally be made using the original payment method.

The time taken for a refund to appear in your account may depend on your payment provider or bank.
